SAN FRANCISCO — The Ninth Circuit ruled that a Nevada federal court should not have dismissed, for lack of standing, a lawsuit against the Department of Agriculture and the Food and Drug Administration over regulations governing the inclusion of information regarding sugars known as FODMAPs on product labels. A food company wants to disclose FODMAP levels on food labels, as does an individual plaintiff who struggles to digest them, but they say federal law prohibits including this information on labels in violation of their First Amendment rights to speak and receive this information. The individual adequately pleaded standing to sue, and the company pleaded standing as a speaker, to pursue their pre-enforcement challenge.
